The below Terms and Conditions form your weekly licence agreement. By booking with us and making payment, you are agreeing to these terms.
This Agreement
- This agreement is made between the Licensor and the Licensee, at the address (herein referred to as “the Property”), listed above.
- This Licence is initially granted for the period confirmed in the Licensee’s booking confirmation. Thereafter, provided the Licensee makes payment in accordance with this agreement and the Licensor accepts that payment, this Licence shall automatically renew on a rolling weekly basis on the same terms and conditions unless terminated in accordance with this agreement. Each renewal constitutes the Licensee’s continuing acceptance of these Licence terms.
- This agreement is a license to occupy and does not grant the Licensee exclusive possession of any room of the Property. The Licensee’s right is personal permission to occupy a room as part of a shared accommodation and the Licensee must not treat the room as exclusively his/her own nor exclude the Licensor, the House Manager, staff or contractors from lawful access or from providing services stated in Clause 14/15. The parties to this agreement intend that this arrangement is not an assured tenancy or assured shorthold tenancy and does not confer security of tenure under the Housing Act 1988.
- The Licensor may, acting reasonably for the purposes of managing the Property and delivering services under this agreement, require the Licensee to move to alternative accommodation within the Property or another property managed by the Licensor. This is entirely at the Licensors discretion.
4.1 Services delivered pursuant to this agreement include, but are not limited to:
4.1.1 Cleaning; 4.1.2 Inspection; 4.1.3 Maintenance; 4.1.4 Safeguarding;
4.1.5 Compliance; 4.1.6 Operational requirements.
4.2 Where reasonably practicable, the Licensor will provide not less than 24 hours’ notice of such a move but may require an immediate move where necessary for safety, urgent works, or to comply with legal obligations.
- The Licensor reserves the right not to renew the Licensee’s licence following which the Licensee must vacate the Property. Once notice is given to terminate the licence, the room is then advertised for others to book. Further details on termination of this agreement are set out below.
- Identification Documents on Arrival: it is mandatory for the Licensee to show a valid identification document to the House Manager on arrival for checking and copying as per our Privacy Policy.
- Regulatory and Compliance Documentation: the Licensee acknowledges receipt of the Property compliance information electronically in relation to this agreement.
7.1 The Property compliance documentation made available in your boking confirmation email is as follows:
7.1.1 Gas Safety Certificate, 7.1.2 Energy Performance Certificate; 7.1.3 Electrical Safety Certificate;
7.1.4 Fire Safety Certificate; 7.1.5 Licensor’s Privacy Policy; 7.1.6 Licensor’s Refunds Policy, and;
7.1.7 Licensor’s Complaints Policy.
7.2 If the Licensee requires hard copies of the above documentation, this is to be made known to the Licensor, in writing.
- The accommodation is provided as flexible, serviced, shared accommodation and is not intended to be the Licensee’s permanent accommodation. At the Licensor’s discretion, there is no maximum length of stay at the Property, however the Licensor reserves the right to periodically require room changes for operational reasons and reserves the right not to renew the licence at the end of any booking period.
- By signing, the Licensee agrees to follow the below terms and conditions of your stay, the potential charges outline in Clause 30, to receive the digital copies of the documents listed above, and to the digital policy documents.
- In the event of any disputes, we are members of the property redress scheme (0333 321 9418). This agreement is governed in accordance with the laws of England and Wales.
- If any of the licensee’s circumstances change in relation to our Terms & Conditions, you must notify the Licensor immediately.
- If there are any changes to Terms & Conditions made by the Licensor, you will be given 2 months’ written notice.
- The Licensor will process the Licensee’s personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data will be used only for the administration and management of this Licence Agreement, to comply with legal obligations, and may be shared where required by law.
Services Provided under this Agreement
- The Licensor provides services that are included in the Licensee’s weekly fee.
14.1 The services that the Licensor will provide are as follows:
14.1.1 Use of the room and communal areas; 14.1.2 All utilities (gas, electricity, water, Broadband, TV Licence);
14.1.3 Council tax; 14.1.4 Cleaning of communal areas;
14.1.5 Gardening (if applicable); 14.1.6 Bedding and linen provision;
14.1.7 Consumable items 14.1.8 General Maintenance and repairs of the Property
- Mandatory Room Access: as part of the services, the Licensor and / or its staff, will access rooms every 2 weeks to provide clean bedding and carry out a safety inspection.
15.1 The access of the room will include, as reasonably practicable:
15.1.1 Provision of clean bedding (licensee to make bed) 15.1.2 Removal of dirty bedding (Licensee to strip bed)
15.1.3 Maintenance and Safety checks 15.1.4 Checks for potential additional cleaning
15.2 The Licensee may request that the access be scheduled at a mutually convenient time within a reasonable window, but the access cannot be declined or permanently postponed. Rooms that are not kept clean and tidy may affect the efficiency of the checks required.
15.3 The Licensor may conduct the services and inspections referred to in Clauses 14 and 15 at such times as are reasonably required for the management, maintenance, compliance, safeguarding and operation of the Property.
Terms and Conditions of Occupation
- No Smoking or candles anywhere inside or outside the Property. The Licensee must leave the Property boundaries completely to smoke. Property boundaries include front & rear gardens, outbuildings etc, and must be beyond the boundaries & away from open windows.
- The rooms are single occupancy only. No evening/overnight guests are allowed, as this puts pressure on bathrooms and kitchens; day visitors between 10.00am and 5.00pm are permitted only by agreement from the Licensor. The Licensee is strictly prohibited from permitting other persons to occupy the room or to sublet the room.
- No pets are allowed in the Property at any time.
- The Licensee must not change, replace, add or tamper with any lock or security device to the room or Property, nor fit any additional lock, without the Licensor’s prior written consent. Any lock change required for operational or safeguarding reasons will be arranged by the Licensor and the Licensor/Housing Manager / contractors will retain working keys at all times. The Licensee acknowledges that any agreement to restrict access is not intended to confer exclusive possession.
- Communal Areas: The Licensee shall use all communal areas, including kitchens, bathrooms and shared living spaces, respectfully and considerately towards other Sharers. The Licensee must clean up after themselves immediately after use, including washing up or loading items into the dishwasher, wiping down surfaces, putting away dry washing up, flushing and leaving toilets clean, removing hair from sinks, baths, showers, floors and plugholes, and hanging wet bathmats to dry. The Licensee must keep personal belongings within their allocated room or designated storage space so that communal areas remain tidy and accessible for cleaning. Waste must be separated and disposed of in accordance with the recycling and waste instructions provided at the Property. Toilet roll must not be removed from the bathrooms and no items other than toilet roll may be flushed down the toilet.
- Don’t cause a nuisance for other Sharers in the house, or for Neighbours, through untidiness, intrusiveness or inappropriate behaviour. Keep noise down, and if the Licensee is unsure what is too noisy, they are to confirm this with the House Manager and keep noise down when requested. The Licensee must ensure to be quiet in communal areas after 10.00pm.
- No Antisocial behaviour will be permitted at the Property.
22.1Antisocial behaviour includes, but is not limited to:
22.1.1 Abusive, discriminatory behaviour 22.1.2 Possession / use of illegal drugs; 22.1.3 Harassment; 22.1.4 Hate crimes; 22.1.5 Drunkenness; 22.1.6 Criminal damage 22.1.7 Excessive noise/disturbance 22.1.8 Violent, threatening, intimidating behaviour
22.2 The Licensor will treat any anti-social behaviour as a serious breach of this agreement and may terminate the licence with immediate effect and report behaviour to the relevant authority, as necessary.
- The Licensee must keep the room reasonably tidy and hygienic and must not obstruct access for the service/inspection. The Licensor remains responsible for delivering the service/inspection, as outlined in Clause 14 & 15 above. More information is provided on the “Sharers Responsibilities” sheet on the notice board and in our online general documents. The House Manager will notify the Licensee of entry to carry out these services.
- Room Entry: The Licensor/House Manager/staff/contractors reserve the right to enter the room at reasonable times to deliver the services necessary as per Clause 14 & 15, for inspection, cleaning, maintenance, compliance checks, and other reasonable management purposes. The Licensor will provide reasonable notice where practicable (normally at least 24 hours) and will knock and announce themselves before entry. Entry may be without notice in emergency or where urgently required for safety or legal compliance. The Licensor, House Manager, authorised staff members and contractors retain keys to the rooms at all times. These members of staff retain access to the communal areas 24/7.
- Heating is set to mornings & evenings, do not interfere with heating settings. If you are cold, please let the office know. We can look at adjusting the heating and/or the licensor may provide an approve supplementary heater. Personal heaters/electric clothes dryers/ industrial air-cooling units of any kind are not permitted in the Property. If the Licensee brings or uses a prohibited heater, the Licensor may remove it for safe keeping and treat this as a breach of this agreement. The Licensor also reserves the right to recover any evidenced additional electricity cost or damage caused by the breach.
Health and Safety
- The Licensee must ensure to consider others by turning off ovens/hobs when finished and cleaning bathroom/kitchen floors to prevent slip hazards after showering or spillages. Please ensure sanitary products are disposed of appropriately.
- If the Licensee has an electric bike or scooter, charging is only permitted by prior approval by the Licensor, and surcharges to the room rate may apply. The Licensee must not leave the electric bike or scooter charging overnight or if they are not in the house, due to the fire risks with the batteries. By signing this agreement, the Licensee agrees to follow the charging fire safety rules, which are displayed in the house and in the documents link sent to you via email.
- In case of fire: alert others loudly and exit the building quickly via the nearest fire exit. The Licensee agrees by signing this agreement to read and follow the fire safety information provided on the notice board. Failure to adhere to this information is a breach of the Terms & Conditions of your stay and this agreement.
- Security: Keep front and rear doors locked and report strangers. Do not share personal details of other sharers.
- Insurance: The Licensee’s personal belongings are not covered by the Licensor’s insurance, and it is the Licensee’s responsibility to arrange suitable contents insurance. The Licensor shall not be responsible for loss of or damage to the Licensee’s personal belongings except where such loss or damage results from the Licensor’s negligence or breach of this agreement.
Damages
- The Licensee authorises the Licensor to recover from the payment card used for the booking the reasonable cost of any sums properly due under this agreement, including unpaid licence fees, damage, excessive cleaning, lost or unreturned keys, locksmith costs, replacement items, and other reasonable costs arising from the Licensee’s breach of this agreement. This does not prevent the Licensee challenging the charge.
- The Licensor will not charge the Licensee for fair wear and tear arising from the ordinary and reasonable use of the room, furniture, fixtures, fittings or communal areas. Charges will only be applied where loss, damage, excessive cleaning, replacement or remedial work is reasonably required as a result of the Licensee’s actions, omissions, negligence, misuse of the Property, breach of this agreement, or circumstances for which the Licensee is reasonably responsible.
- Before processing any charge under Clause 31, the Licensor will, where reasonably practicable, notify the Licensee of the nature of the charge and provide reasonable supporting evidence upon request.
- The Licensee remains entitled to dispute any charge which they believe has been applied incorrectly.
- If the Licensee identifies any damage, missing items or maintenance concerns upon arrival, the Licensee should notify staff as soon as reasonably practicable.
- Where reasonably practicable, the Licensor may rely on photographs, inspection records, invoices, quotations, receipts, contractor reports or other supporting evidence when assessing charges under this clause
- No damage deposit is required or held under this agreement.
Payments
- The fee for the room is payable weekly. Weeks run Sunday-Sunday. The Licensee’s weekly licence is renewed for future weeks by paying in advance by the preceding Wednesday before 12.00pm.
- The initial £60.00 reservation fee is taken to hold a room for you. A room is allocated, however allocation is subject to change under Clause 4 of this agreement. This fee is then deducted from the Licensee’s total booking payment, and the remaining balance is due to be paid on the day of the Licensee’s arrival, prior to move in.
- Payment received by 12.00pm on Wednesday will renew this Licence for the following weekly period (or such further weeks as are paid for). If payment is not received by the renewal deadline, and no alternative arrangement has been agreed in writing, the current Licence shall expire automatically at the end of the current paid period without further renewal.
- Payments for block bookings, or Monthly pro rata payments are administrative payment options only and do not create a periodic tenancy. All terms of this weekly licence still apply.
- Weekly Room rates are subject to change. If this is the case, the Licensor will provide 2 months’ written notice of these changes.
- Block bookings of 4 weeks or more will receive a £10.00 per week discount.
Termination
- The Licensor reserves the right to terminate this licence agreement by giving not less than 48 hours’ written notice, or with immediate effect in the event of serious breach such as items listed in Clause 22, misconduct, or non-payment.
- The Licensee may terminate the licence at any time by providing 4 days’ written notice to the Licensor.
- Non-payment of the room will also constitute as a Licensee’s notice to terminate the licence.
- Upon termination the Licensee must vacate the room, leaving it in good order, and return all keys.
- Abandoned Property: The Licensor may remove and store any belongings left at the Property following the termination or expiry of this Licence. If the Licensee fails to collect them within 14 days of being notified, the Licensor may dispose of them as reasonably considered appropriate. The Licensee shall be liable for any reasonable storage or disposal costs incurred
- Notices: Any notice required under this Licence Agreement shall be given in writing and may be served by hand, first class post or email using the contact details most recently provided by the parties.
49.1 A notice sent by email shall be deemed received on the day it is sent, provided it is sent before 5.00pm on a Business Day. Otherwise, it shall be deemed received on the next Business Day.
49.2 It is the Licensee’s responsibility to notify the Licensor promptly of any change to their postal address, email address or telephone number.
